BIO
David is a founding member and the Managing Partner of MacMain Leinhauser PC. David has broad and extensive trial experience having tried over 150 cases to verdict in favor of his clients. David has, over the course of his thirty plus year legal career, focused his practice on the representation and counseling of public entities, public officials, educational institutions, religious entities, and non-profits throughout Pennsylvania, in a wide variety of civil rights and employment claims including police misconduct, zoning/land use, sexual harassment, discrimination, licensing, First Amendment, prison-based, employment, and work-place claims. David is frequently retained as a consultant and/or lead trial counsel in high-profile §1983 and municipal liability cases throughout the country. He also serves as the Solicitor for the Chester County Sheriff’s Department, West Chester Civil Service Commission, and is counsel to law enforcement agencies and correctional facilities on various issues including the review and preparation of policies, and operational issues.
David is a member of The Federation of Defense and Corporate Counsel, an international organization limited to 1400 lawyers worldwide who are selected by invitation only following an extensive peer review selection process, and Vice- chair of the Government Liability and Trial Tactics Committees. David is also a member of the Association of Defense Trial Lawyers, an invitation only organization that names only one lawyer per one million in population based on their trial skills. David currently serves of Vice-Chair of the Diversity and Inclusion Committee. David is a member of the Defense Research Institute and an active participant in the Government Liability, Trial Tactics, and Law Firm Management Committees. David has previously served as the Chair of the Governmental Liability Committee from 2019-2020, was the 2013 Program Chair of the annual conference and has been a featured speaker at several annual conferences.
David has been selected to the “Pennsylvania Super Lawyers” each year since 2004 in the field of Civil Rights as selected by an anonymous survey of lawyers and judges statewide, representing the top five percent of all lawyers in Pennsylvania. David is rated “AV” Preeminent 5.0 out of 5.0 by Martindale-Hubbell both as to his substantive legal abilities and his ethical standards.
David is a frequent speaker on civil rights, municipal liability, employment litigation, police and prison-related issues, zoning and land use, trial skills, and ethics to a variety of audiences, both locally and nationally, including law enforcement agencies and organizations, public officials, lawyers, solicitors, and insurance professionals.
CAREER
After graduating from college, and prior to beginning his legal career, David served as a Pennsylvania State Trooper stationed at the Avondale, Chester County Barracks where he engaged in all aspects of police work including patrol, accident investigation and criminal investigation, in the twenty-seven (27) municipalities that the Avondale station covered. David worked several jobs to support his family while putting himself through law school at Temple University School of Law.
David began his legal career with the Philadelphia law firm of Montgomery McCracken where he began as a clerk during his final year of law school, thereafter worked as an associate for seven years, before being named a partner in 1997. During his eighteen year tenure at Montgomery McCracken, David served as Chair of the Governmental Liability and Civil Rights Practice Group, Vice-Chair of the Insurance Defense Practice Group, and as a member of the firm’s Hiring Committee, Diversity Committee, and Summer Associate Committee.
